The Burgas Police detained a drug dealer named Asam M. for illegally distributing drugs and narcotic substances. After conducting a search in his house, police found twenty-three pieces of methamphetamine in a plastic cylinder bottle. District court of Burgas remanded him for 72 hours to carry out further investigation.

The suspect, Asam M., is expected to get two to eight years of imprisonment for the attempted crime. In addition, he can also get a fine of five thousand to twenty thousand BGN. According to the records, the accused is unemployed and has a lengthy criminal history, including convictions for crimes under the Criminal Code’s Article 343b, Paragraph 3, and Article 354a, Paragraph 3, Proposition 2, Item 1, Proposition 1, for which he was given “Imprisonment” penalties. This is evident from the criminal record that was attached to the pre-trial proceedings.

The court determined that the circumstances in this instance meet all the legal requirements for applying the most severe form of remand to the accused, including a valid assumption of guilt and the threat of further criminal activity or fleeing. All evidence, in this case, indicates that the probability of committing a crime again by the accused is very high, and he is a danger to the public.

Although Asan M. still commits actions of a similar sort, the activity in the current instance was carried out relatively shortly after he completed his “Imprisonment” sentence on September 20, 2021. The accused is “characterised as a person with a heightened degree of public risk, inclined to perpetrate similar/one type of crimes,” the court stated.

The defence’s argument regarding the defendant’s marital status does not outweigh the present risks. It does not support the imposition of a lighter detention measure when considered in the context of the charged offence, the analysed presumption of a real danger of committing another crime, and the need to ensure his appearance and participation in criminal proceedings.
